1. Acceptance of Terms

By accessing or using Candidate Evaluator, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

Candidate Evaluator is an AI-powered decision-support tool designed to assist with candidate screening and evaluation. It provides:

  • Automated resume analysis against job descriptions
  • Similarity scoring and ranking
  • AI-generated insights about candidate strengths and gaps

Important: Our service is intended to augment, not replace, human judgment in hiring decisions. All final employment decisions remain the sole responsibility of the user.

3. User Responsibilities

As a user of Candidate Evaluator, you agree to:

  • Accuracy: Provide accurate and truthful information in your account registration
  • Security: Maintain the confidentiality of your password and account credentials
  • Compliance: Use the service in compliance with all applicable laws, including equal employment opportunity and anti-discrimination laws
  • Fair Use: Not misuse the service to discriminate, harass, or violate the rights of candidates
  • Data Rights: Ensure you have the right to upload and analyze all candidate data you submit

4. Prohibited Uses

You may not use Candidate Evaluator to:

  • Violate any applicable law or regulation
  • Discriminate against candidates based on protected characteristics (race, gender, age, disability, etc.)
  • Reverse engineer, decompile, or attempt to extract the source code of our service
  • Scrape, harvest, or data mine without authorization
  • Resell or redistribute access to the service
  • Upload malicious code, viruses, or harmful content

5. Account Management

Registration: You must create an account to use Candidate Evaluator. You are responsible for all activity that occurs under your account.

Termination: We reserve the right to suspend or terminate accounts that violate these Terms of Service or engage in abusive behavior.

Account Closure: You may close your account at any time through your account settings.

6. Refunds and Balance Policy

Pre-paid Balance: Our service operates on a pre-paid balance system denominated in USD.

Default Policy: Except as required by the Australian Consumer Law, all purchases are final. We do not offer refunds for change of mind or unused balances.

Promotional Credits: Any balance granted as a 'Sign-up Bonus' (e.g., the Test Drive), 'Volume Bonus,' or other promotion has no cash value and is strictly non-refundable and non-transferable.

Bundle Refunds: If a refund is legally required for a discounted bundle (e.g., 'Hiring Sprint'), the refund amount will be calculated as the total price paid minus the standard single-job rate for any analyses already performed.

Expiration: Your balance does not expire as long as your account remains active. We reserve the right to expire balances on accounts that have been inactive for more than 12 months.

Consumer Guarantees: We honor all statutory guarantees under the laws of the State of Queensland, Australia. Nothing in these terms excludes your rights regarding services that are not provided with due care and skill or are unfit for purpose.

Pricing: Current pricing is displayed on our pricing page and may be updated from time to time.

Payment Processing: All payments are processed securely through Stripe.

7. Intellectual Property

Your Content: You retain all rights to the resumes and job descriptions you upload. We only use this data to provide our service.

Our Service: Candidate Evaluator, including its design, code, algorithms, and analysis outputs, is our intellectual property and is protected by copyright and other laws.

AI Outputs: The insights and analysis results generated by our service are provided to you for your use in your hiring decisions.

8. Disclaimers and Limitations

No Warranty: To the extent permitted by law, and except for the consumer guarantees provided under the Australian Consumer Law, our service is provided "as is" without warranties of any kind. We do not guarantee:

  • The accuracy, completeness, or reliability of AI-generated insights
  • That the service will be uninterrupted or error-free
  • That all candidate evaluations will be perfect or free from bias

Human Oversight Required: AI analysis should always be reviewed and validated by qualified human decision-makers.

Limitation of Liability: To the maximum extent permitted by law, Candidate Evaluator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

9. Compliance with Employment Laws

Users are solely responsible for ensuring their use of Candidate Evaluator complies with all applicable employment laws, including but not limited to:

  • Equal Employment Opportunity (EEO) laws
  • Americans with Disabilities Act (ADA)
  • Age Discrimination in Employment Act (ADEA)
  • GDPR and other data protection regulations

Our tool is designed as a neutral analysis system, but users must ensure their hiring practices comply with all legal requirements.

10. Service Changes and Termination

We reserve the right to:

  • Modify or discontinue features of the service with reasonable notice
  • Update pricing with 30 days notice to existing customers
  • Terminate the service entirely (with refunds for unused balance purchased within 90 days)

11. Governing Law

These Terms of Service are governed by the laws of the State of Queensland, Australia, without regard to its conflict of law provisions.

12. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
